These Terms of Service ("Terms") govern your access to and use of the BurtAI website at hiburt.com and the BurtAI platform at app.hiburt.com (collectively, the "Services"), operated by BurtAI, Inc. ("BurtAI," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Description of Services

BurtAI is a technology platform that connects individuals who have been injured in accidents with medical providers who offer treatment on a medical lien basis (no upfront cost to the patient). BurtAI is not a medical provider, law firm, or insurance company. We do not diagnose conditions, prescribe treatment, or provide legal advice.

Our Services include:

• Intake questionnaires to assess your eligibility for medical lien-based care
• Referrals to participating medical providers in your area
• Appointment coordination with medical providers
• Anonymized case summaries shared with law firms who may be interested in representing you (with your consent)

2. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

3. No Medical Advice

The information provided through BurtAI's Services is for informational and referral purposes only. It does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information you received through our Services.

4. No Legal Advice

BurtAI is not a law firm and does not provide legal advice of any kind. No attorney-client relationship is created by your use of our Services. If you need legal advice, you should consult a licensed attorney in your jurisdiction. Any information about law firms provided through our Services is for referral purposes only.

5. Medical Lien Financing

Medical lien-based care means that the participating provider agrees to treat you now and receive payment from any future settlement or judgment in your personal injury case. BurtAI does not guarantee that you will qualify for lien-based care, that any settlement will occur, or that any particular outcome will result from medical treatment. Decisions about medical lien agreements are made solely between you and the participating provider.

6. User Responsibilities

By using our Services, you agree to:

• Provide accurate, complete, and current information in all intake forms and communications
• Not misrepresent your identity, accident history, or injuries
• Not use our Services for any unlawful purpose
• Not attempt to access systems, data, or accounts that do not belong to you
• Not interfere with or disrupt the integrity or performance of our Services

7. SMS Communications

By providing your phone number, you consent to receive text messages from BurtAI regarding your inquiry, appointment coordination, and status updates. Message frequency varies. 8. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.

All content, features, and functionality of the Services — including text, graphics, logos, and software — are the exclusive property of BurtAI, Inc. and are protected by applicable intellectual property laws. BURTAI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BURTAI, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

You agree to indemnify and hold harmless BurtAI, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another party.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
